S&C Co-Chair Bob Giuffra spoke with Litigation Daily on the 2025 litigation forecast, noting that predictions about the “next big thing” in litigation often do not pan out, as major trends are influenced by “unexpected market events.” “Where the litigation will come from for big law firms is anyone’s guess, because it will be a function of macroeconomic factors that are just beyond all of our controls.”
Bob offered a look into how S&C’s litigation team is preparing for the coming years, highlighting the efforts of Jeff Wall and Morgan Ratner to build out the Firm’s appellate practice and the prospect of a more business-friendly Supreme Court. “There hasn't been a six-three conservative majority on the Supreme Court probably since Taft,” Bob noted.
Despite expectations that the incoming administration will favor a pullback in regulation and enforcement, Bob anticipates that market and company-specific developments will guide government-driven litigation. “If there’s a big scandal out there, in whatever industry it occurs, they will look at it,” he said. “They’re not just going to sit there if some major company has engaged in fraud, particularly if it’s fraud impacting lots of people or huge losses.”
