Perfect Day, an innovator in developing sustainable protein products using precision fermentation, prevailed in a third-party requested reexamination of one of its cornerstone patents before the U.S. Patent and Trademark Office. Perfect Day’s flagship product, the world’s first precision-fermented milk protein, is used in animal-free dairy products, including ice cream, cream cheese and baked goods.
The S&C team overcame the patent examiner’s initial rejection of all claims of the patent and convinced the examiner to allow those claims in March 2024. The team submitted a lengthy and detailed response to the examiner’s initial rejection, successfully explaining in detail the patent’s innovations and why they provided substantial improvements over prior work in the field.
