S&C represented Barclays Bank before the Appellate Division of the New York Supreme Court, First Department, which unanimously affirmed a lower court decision that dismissed breach-of-contract claims brought by hedge fund BDC Finance against Barclays.
The New York Supreme Court Commercial Division previously dismissed the case after a two-day bench trial, finding that Barclays complied with the parties’ agreement related to the performance of financial instruments, primarily comprised of high-yield corporate debt that was held by Barclays, and fulfilled its financial commitment to BDC.
