On June 13, 2020, S&C partner Joe Neuhaus appeared before the New York State Bar Association House of Delegates to present revisions to certain of the Comments to the New York Rules of Professional Conduct on behalf of the NYSBA Committee on Standards of Attorney Conduct, of which he is a former chair and current member. The proposed revisions addressed lawyers’ duties with respect to protecting confidential information from digital intrusion, lawyers’ duties in communicating on social media platforms with persons represented by other lawyers, and proposed amendments to the New York rules on lawyer advertising to permit law firms to use trade names (rather than only the names of present or former members of the firm). The House of Delegates passed the proposals by an affirmative vote of 93% of those voting.
